Defective Hip Replacements & Medical Devices

When people are injured, they are often in their most vulnerable states physically, mentally, and emotionally. Dealing with even a minor physical injury puts serious strain on both the injured individual and their family members. When they reach out for medical assistance and are given items and/or procedures that are supposed to help them, they put an enormous amount of faith in these prescribed methods. Their physical well-being (and, in turn, their mental well-being) often rests almost entirely on the materials/procedures their doctors have given them.

Defective Medical Devices at the Lake of the Ozarks

When a patient is given a medical device, she will often rely on that device to improve her quality of life and potentially even to keep her alive. With so much stock placed on these medical devices, it can be devastating when they fail to help the patients as promised - and even worse when they not only fail to help, but actually make the issue worse. At our personal injury law firm at the Lake of the Ozarks, we understand the emotional and mental turmoil that can come from such an event, and we aim to do everything our power to defend our clients who experience such issues.

Defective Hip Replacements at the Lake of the Ozarks

Recently, there has been increased attention drawn to defective hip replacements and the repercussions they are causing. Hip replacements are major surgeries and can have serious consequences when they are done incorrectly or use defective materials. Recently, there has been a great deal of attention given to two specific products: DePuy Orthopaedics and Stryker Rejuvenate.

DePuy Orthopaedics
DePuy Orthopaedics, a division of Johnson & Johnson, recently had to recall two widespread hip replacement systems: the DePuy ASR XL Acetabular Hip Systems and ASR Hip Resurfacing Systems. These implants have defective designs that causes metal to rub against metal, resulting in pain, swelling, difficulty walking, and high amounts of toxicity in the patient's bloodstream.

These DePuy systems have been widely used since 2003, and experts estimate that roughly 93,000 of these recalled ASR systems have been implanted across the globe. Unfortunately, recent data has shown that as many as one in eight patients required a second surgery within five years of the initial hip replacement surgery.

Stryker Rejuvenate
The Stryker Rejuvenate Modular Primary Hip System (designed by the Stryker Corporation, one of the world's largest medical technology companies) originally garnered a great deal of positive attention because it is designed in such a way that allows doctors to customize the implant to perfectly meld with each patient's unique physical anatomy. Unfortunately, Stryker systems have led to a wide variety of negative side effects, ultimately leading to permanent bone and tissue damage as well as heavy metal poisoning.

The Stryker Rejuvenate system was released in February of 2010, and recalled in July of 2012. As with the DePuy systems, thousands of patients had already received these defective implants.

Boating Accidents on the Lake of the Ozarks

The Lake Area is well-known as a top vacation destination in the Midwest, with several attractions for people of all ages and from all backgrounds. Boating on the Lake of the Ozarks is top on the to-do list for most tourists (and many of the locals). Boating is a wonderful activity for people of all ages, but there are several risks associated with it that should not be taken lightly.

Boating on the Lake of the Ozarks

Motor vehicles that operate on land are carefully regulated to ensure that only competent, capable drivers get behind the wheel. Teenagers aren't allowed to drive cars unsupervised until they are sixteen years old, and drunk drivers face serious consequences for their actions.

For some reason, many people do not realize that the law treats operating a boat as seriously as they do cars - boaters may allow young, inexperienced drivers to take the helm, or they may opt to drive themselves boat after having a few drinks. What these people fail to realize is that operating a boat is just as regulated as operating a car or motorcycle, and that accidents resulting from negligent or drunk boaters also bring serious legal consequences.

Consequences of Boating Accidents on the Lake of the Ozarks

The term "boating accident" refers to any accident involving boats, waverunners, jet skis, or cruisers. The most common reasons for boating accidents at the Lake of the Ozarks are as follows:
  • Operator Negligence
  • Inexperience
  • Excessive Speed
  • Alcohol Usage
Operator negligence takes several different forms, including operating the boat in dangerous weather or driving too closely to swimmers. If you have been injured at the hands of a boat driver has shown any of these signs, you may have the right to financial compensation for your medical bills, property damages, and accompanying pain and suffering. Boating accidents should be handled similarly to automobile accidents - preserving evidence from these accidents is often crucial to the success of your case. If you have been injured in a boating accident, we encourage you to contact our boating accident attorney at the Lake of the Ozarks immediately.

High-Quality Representation for Your Boating Accident

The team at McDuffey Law Firm LLC would like to remind you all to stay safe on the water this summer season. While you obviously cannot control the actions of the other boaters around you, you can do your part by wearing a life jacket and staying attentive and alert. Together, we can work to make boating on the Lake of the Ozarks a safer experience for everyone involved.
